Criminal enforcement of Patent Law

 

It is fair to say that the legal protection of the intellectual property rights (IPRs) in Egypt is a main concern. It is not only a concern for investors but also for the individuals whose capital and income heavily depend on the legal protection of their intellectual contributions to the society. Of course, the enforcement of the Egyptian Intellectual Property Law (IPL) has not been effective and efficient in protecting the intellectual property rights related to copyrights, trademarks, patents, etc. However, it is a good sign that courts are willing to criminally enforce the IPL when necessary, as happened in a 2015 case that involves Marcyrl Pharmaceutical Industries' infringement of Merck Sharp & Dohme (MSD)'s patent.
